This ruling halts the left’s latest scheme to drain taxpayer resources and rewards those who’ve broken the nation’s immigration laws.

U.S. District Judge Daniel M. Traynor granted a stay and preliminary injunction against a Biden administration rule that would have allowed so-called “Dreamers” access to the Affordable Care Act (ACA) marketplace.
This decision prevents the Department of Health and Human Services from enforcing the rule in 19 states that joined the lawsuit led by Kansas Attorney General Kris Kobach.
Judge Traynor’s ruling exposed the Biden administration’s overreach, stating that the Centers for Medicare and Medicaid Services (CMS) “acted in excess of statutory authority” by attempting to redefine who is considered “lawfully present” under the ACA.
This blatant disregard for congressional authority would have made an estimated 147,000 illegal immigrants eligible for taxpayer-funded health benefits.

Kansas Attorney General Kris Kobach celebrated the court’s decision, emphasizing its significance in protecting American taxpayers from funding healthcare for illegal aliens.
Kobach’s exposed the Biden administration’s attempt to circumvent existing laws:
“This decision is a big win for the rule of law. Congress never intended that illegal aliens should receive Obamacare benefits. Indeed, two laws prohibit them from receiving such benefits. The Biden administration tried to break those laws. But we fought back and defeated the Biden Justice Department.”
The DACA program, initiated by former President Barack Obama, already pushes legal boundaries by shielding certain illegals from deportation and allowing them to work legally.
However, even this controversial program does not make them eligible for government-subsidized health insurance.
The Biden administration’s latest move was a clear attempt to expand benefits far beyond what Congress ever intended.
Judge Traynor’s ruling also highlighted the potential harm to states if forced to comply with this unlawful expansion.
He noted that the rule could encourage more illegal immigration, causing economic harm to states through increased licensing and education costs.
