(AmericanProsperity.com)- A feminist advocacy organization is currently suing the California Department of Corrections and Rehabilitation, claiming that policies to house biological males (transgender females) in women’s prisons endanger female inmates. The Women’s Liberation Front (WLF) lawsuit claims a new law known as the Transgender Respect, Agency, and Dignity Act, or SB 132, violates women’s First, Eighth, and Fourteenth amendments.
SB 132 requires the Department of Corrections and Rehabilitation to classify inmates during intake. They must ask each person in custody to identify whether they are transgender, intersex, nonbinary, or some other honorific, and which gender pronouns they go by.
The bill ensures DOC personnel adhere to such protocols and consistently use an inmate’s preferred gender pronouns. However, it also explicitly forces the correctional facility to place them in the facility that aligns with how they identify.

The WLF’s lawsuit argues that the courts cannot enforce SB 132 without violating plaintiff Krystal Gonzalez’s state and federal constitutional rights. Gonzalez claims a biological male sexually assaulted her after being transferred from a male prison under the new law. She filed a complaint and requested a transfer shortly after the incident.
In a statement, Gonzalez indicated that she doesn’t believe women have penises and that she’s suffered destructive physiological distress over the assault. She says the situation further devolved after the prison refused to acknowledge the sex of her attacker.
SB 132 went into effect in September of last year when California Gov. Gavin Newsom signed it to support the “health and safety” of transgender individuals.
California houses more women in prisons than any other country in the world. Now, those individuals must share a cell with biological men. The lawsuit claims the issue is so severe that female inmates set sleep schedules among themselves to avoid assault.
