Casper also blocked other parts of the same order that aimed to tighten mail voting, like rules against counting ballots that arrive after Election Day.[8]
Trump’s team argued the lawsuit was premature because the new rules were not fully in place yet. The judge rejected that argument and agreed with Democratic state attorneys general who warned the order would tip the balance of power over elections away from states and Congress.[8]

They warn that these rules turn what should be a simple form into a time‑consuming trip through government offices. They also stress that research finds noncitizen voting to be extremely rare and usually the result of honest mistakes, not organized fraud.[27]
What This Ruling Signals For The Next Election Fights
The Casper decision sends a clear signal about the next phase of the election wars: presidents cannot claim quick, sweeping power over who gets on the rolls.
If Americans want proof‑of‑citizenship requirements nationwide, they must persuade Congress or change laws in their own states. That design matches the original constitutional structure, even if it frustrates those who want fast change in either direction.[6]
The ruling is both a warning and an opportunity. It warns that short‑cuts through executive orders will not survive serious court review.
It also highlights the path that does respect the Constitution: build durable laws through Congress and state legislatures, support audits and data instead of only anecdotes, and make the case that tightening the front door of the voter rolls can be done without slamming it on lawful citizens.
